Membership Agreement

1. Parties and Approval

This contract has been mutually accepted and entered into force between M&K Teknoloji Trading LTD (Seller), located at Sanayi Bölgesi 20. Sk, Lefkoşa / Cyprus, which operates the website www.kibristeknoloji.com (Site), and the user (Member) who electronically approves while becoming a member of the site. The Member declares that they have read, understood, and committed to comply with all the provisions of the contract with their digital approval.

  • Site: It is an online platform where services and content are provided within the framework set by the seller.
  • Member / Buyer: The person, either real or legal, who registers on the site and benefits from the services/products offered under the terms of the contract.
  • User: It is for everyone who visits the site, whether shopping or not.

3. Subject and Scope of the Agreement

  • The subject of the contract is to determine the conditions for benefiting from the offered e-commerce services and the mutual rights and obligations of the parties.
  • Basic service; The delivery of products paid for by the Member to the Buyer without defects, through a shipping/courier company, within the promised time frame, depending on the supply and stock status.
  • The seller has the right to completely change the scope, nature, and membership features of the services at their own discretion. The updates take effect as soon as they are published on the Site.

4. Membership and Service Use Terms

  • Membership is completed by filling out the registration form and being approved by the Seller. Until this process is completed, Member rights and privileges cannot be obtained.
  • To be able to register on the site, it is mandatory to be of legal age (at least 18 years old) or to be authorized to represent and bind the company for legal entities.
  • The Seller may temporarily suspend or permanently terminate the Member's membership without providing any justification and without any obligation to pay compensation, in accordance with the contract or site rules, cybersecurity risks, or commercial/legal decisions.

5. Rights and Obligations

  • Compliance with regulations: The member agrees to act in accordance with the applicable legislation, e-commerce rules, and the terms of this agreement in all transactions on the platform.
  • Legal information sharing: In accordance with the mandatory provisions of the applicable legislation or claims of rights violations by third parties, the Seller is authorized to disclose the Member's information to the relevant authorities upon a duly made request by official authorities. The Member cannot claim compensation for this situation.
  • Account security: The security and privacy of the Member's account access tools (username, password, etc.) are entirely their own responsibility. The Seller cannot be held liable for any direct or indirect damages arising from negligence in this regard.
  • Declaration of accurate information: The Member warrants that all information registered in the system is accurate and in compliance with the law. All legal and material liability arising from incorrect or misleading information belongs to the Member.
  • Prohibition of transfer: The Member may not transfer, in whole or in part, the rights and obligations arising from this contract to third parties without the written consent of the Seller.
  • Legal use: The Member may only act for lawful purposes in all actions taken within the site. The Member's use of the site cannot infringe upon the intellectual property rights, personal data, or assets of the Seller, other users, or third parties. In such violations, all legal, criminal, and financial responsibilities are directly attributable to the Member.

6. Intellectual Property Rights

  • All designs, logos, software, trademarks, visuals, and content on the site are the property of M&K Teknoloji Trading LTD and are protected by copyright laws.
  • The Member may not copy, reproduce, distribute, or use these contents for commercial purposes without the written permission of the Seller.

7. Limitation of Liability and Force Majeure

  • The seller cannot be held responsible for the temporary unavailability of the site due to interruptions caused by internet infrastructure, cyber attacks, or technical failures.
  • In the event of delays or inability to deliver orders due to force majeure circumstances beyond the Seller's control, such as natural disasters, fires, wars, strikes, epidemics, or government restrictions, the Seller shall not be held legally responsible.

8. Evidence Agreement

In any dispute arising from this contract, the digital records, system logs, and commercial books maintained by the Seller in their databases and servers shall constitute definitive and exclusive evidence in accordance with the laws of the Turkish Republic of Northern Cyprus.

6. Competent courts

Any disputes arising from the implementation and interpretation of this contract shall be resolved by the courts and enforcement offices of Nicosia.
