Article 1 - Parties

Article 2 - Subject

The subject of this contract is the determination of the rights and obligations of the parties in accordance with the current Consumer Protection Legislation regarding the sale and delivery of the product, which the Buyer has ordered electronically from the Seller's website kibristeknoloji.com, with the qualities and sales price specified below.

Article 3 - Products Subject to the Contract

Article 4 - General Provisions

  • 4.1- The Buyer declares that they have read and are informed about the essential characteristics of the product subject to the contract, the sales price, payment method, and preliminary information regarding delivery on the website kibristeknoloji.com, and that they have provided the necessary confirmation in electronic form.
  • 4.2- The product subject to the contract will be delivered to the Buyer or the person/entity at the address indicated by the Buyer within the timeframe specified in the preliminary information on the website, depending on the distance of the Buyer's residence, provided that it does not exceed the legal 30-day period.
  • 4.3- If the product subject to the contract is to be delivered to a person/entity other than the Buyer, the Seller shall not be held responsible for the refusal of the delivery by the person/entity to whom it is to be delivered.
  • 4.4- The seller is responsible for delivering the product subject to the contract in a sound, complete condition, in accordance with the specifications indicated in the order, along with any warranty documents and user manuals, if applicable.
  • 4.5- In the event that the bank or financial institution does not pay the Seller for the product due to unauthorized use of the Buyer's credit card by unauthorized persons not caused by the Buyer's fault after the delivery of the product, the product must be sent back to the Seller within 3 days, provided that it has been delivered to the Buyer. In this case, the shipping costs are the responsibility of the Buyer.
  • 4.6- Ürünün tesliminden sonra Alıcı'ya ait kredi kartının Alıcı'nın kusurundan kaynaklanmayan bir şekilde yetkisiz kişilerce haksız veya hukuka aykırı olarak kullanılması nedeni ile ilgili banka veya finans kuruluşunun ürün bedelini Satıcıya ödememesi halinde, Alıcı'nın kendisine teslim edilmiş olması kaydıyla ürünün 3 gün içinde Satıcıya gönderilmesi zorunludur. Bu takdirde nakliye giderleri Alıcı'ya aittir.
  • 4.7- If the Seller is unable to deliver the product subject to the contract within the specified time due to extraordinary circumstances such as force majeure, adverse weather conditions that hinder transportation, or interruption of transport, they are obliged to inform the Buyer of the situation. In this case, the Buyer may exercise one of their rights to cancel the order, to replace the product subject to the contract with a similar one if available, and/or to postpone the delivery time until the hindering situation is resolved. If the Buyer cancels the order, the amount paid will be refunded via bank transfer to the account specified by them within 14 days.
  • 4.8- Products sold with a warranty certificate, whether they are covered by the warranty or not, can be sent to the Seller for necessary repairs or replacements if they are defective or faulty. In this case, shipping costs will be covered by the Seller. According to the laws of the TRNC, the legal warranty period for new products is 2 (two) years.

Article 5 - Right of Withdrawal

Alıcı, sözleşme konusu ürünün kendisine veya gösterdiği adresteki kişi/kuruluşa tesliminden itibaren 14 (on dört) gün içinde hiçbir gerekçe göstermeksizin ve cezai şart ödemeksizin cayma hakkına sahiptir. Cayma hakkının kullanılması için bu süre içinde Satıcı'ya yazılı olarak (e-posta veya kalıcı veri saklayıcısı ile) bildirimde bulunulması şarttır. Cayma hakkı kapsamında iade edilen ürünün kargo bedeli Satıcı tarafından karşılanır. Satıcı, cayma bildiriminin kendisine ulaştığı tarihten itibaren 14 gün içinde toplam bedeli Alıcı'ya iade etmekle yükümlüdür.

Madde 6- Cayma Hakkı Kullanılamayacak Ürünler

KKTC Tüketicileri Koruma Mevzuatı uyarınca; Alıcı'nın istekleri veya açıkça onun kişisel ihtiyaçları doğrultusunda hazırlanan mallar, son kullanma tarihi geçebilecek mallar, tesliminden sonra ambalajı açılmış olan ve iadesi sağlık ve hijyen açısından uygun olmayan mallar ile tesliminden sonra ambalaj, bant, mühür, paket gibi koruyucu unsurları açılmış olan bilgisayar sarf malzemeleri, ses veya görüntü kayıtları, yazılım programlarında cayma hakkı kullanılamaz.

Mevzuat ve mesafeli sözleşmeler yönetmeliği hükümleri uyarınca, taraflarca aksi kararlaştırılmadıkça Alıcı aşağıdaki ürün ve sözleşmelerde cayma hakkını kullanamaz:

  • Electronic Devices: The contracts for mobile phones, computers (portable/desktop), tablets, and smartwatches that have been delivered to the consumer without issues and completely cannot be canceled unless the goods are defective (faulty), and returns of these products are not accepted.
  • Personalized Products: Goods that are prepared according to the buyer's requests or explicitly tailored to their personal needs, which have been modified or added to in order to make them personalized.
  • Opened Digital and Consumables: Computer and printer consumables (toner, cartridge, ribbon, etc.) that have protective elements such as packaging, tape, seal, and package opened after delivery, as well as copyable software and programs, DVDs, VCDs, CDs, and cassettes.
  • Products with Installation and Assembly Completed: Electrical/electronic products that are specified in the introduction and user manual to be installed/assembled by the seller or authorized service and have been installed/assembled.
  • Hygienic and Disposable Products: Products whose packaging or protective packaging has been opened after delivery and whose return is not suitable for health or hygiene reasons.

In order for electrical products within the scope, other than the electronic devices mentioned above, to be returned under the right of withdrawal; it is required that the products are unopened, the protective seals are not removed, they have not been tested, used, and there is no condition that would prevent them from being sold as new products to another customer.

Article 7 - Authorized Authorities and Courts

In disputes arising from this contract, the Consumer Arbitration Board is authorized within the monetary limits set by the applicable legislation of the TRNC. In disputes exceeding the authority of the Arbitration Board, the District Courts of the TRNC (Nicosia) are authorized.İşbu sözleşmeden doğabilecek uyuşmazlıklarda, yürürlükteki KKTC mevzuatının belirlediği parasal sınırlar dahilinde Tüketici Hakem Heyeti yetkilidir. Hakem Heyetinin yetkisini aşan uyuşmazlıklarda ise KKTC (Lefkoşa) Kaza Mahkemeleri yetkilidir. 

If the order is fulfilled, the Buyer is deemed to have accepted all the terms of this agreement.
